Collection and processing of information on cases of harm

According to Article 7 of the Federal Law "On Technical Regulation" The Russian government is organizing a permanent recording and analysis of all cases of damage resulting from violations of the requirements of technical regulations, the life or health of citizens, property of individuals or legal entities, state or municipal property, environment, life or animal and plant health, taking into account the severity of the injury, as well as a function for the organization of informing of purchasers, manufacturers and sellers of the situation in compliance with the requirements of technical regulations.

This function by Government Resolution dated June 17, 2004 № 294 assigned to the Federal Agency on Technical Regulating and Metrology.

Currently, the Agency carried out the organizational and staffing measures for the establishment of a federal system to record cases of harm as a result of violations of the requirements of technical regulations.

Operation of the Scheme is expected in the framework of Unified Information System for Technical Regulation, which is a federal public information system. Regulations on the Unified Information System for Technical Regulation approved by Decree of the Russian Federation dated August 15, 2003 № 500.

Immediately collect and analyze information on cases of harm in the regions will implement the Agency's interregional territorial control.

The database of cases of harm will be formed on the basis of evidence of violations of technical regulation requirements identified as a result of ongoing territorial departments of the Agency's supervisory activities as well as on the basis of information from regulatory bodies, manufacturers (performers, sellers, persons performing the functions of the foreign manufacturer), public organizations and citizens. Information database resources will be available to all interested parties.

Articles 37-39 of the Federal Law "On Technical Regulation" establishes the procedure for informing the supervisory authorities of cases of non-compliance issued in the product to the requirements of technical regulations. The algorithm of this procedure is shown in Figure 1.
